The story you've been told about AI is that compute is basically free and endless. Build the feature, ship the model, scale the inference, and the bill just goes down over time. That story now has a wall in front of it, and the wall is made of power lines, water rights, and angry neighbors. Let me catch you up.

The deep cut

The state that wanted the boom just paused it

Texas built its whole pitch on loose rules and cheap power. Then it hit a ceiling. Governor Greg Abbott ordered every new data center to pass an audit from the state's utility commission and grid operator before it can connect. ERCOT is tracking 474 gigawatts of connection requests, about 90 percent of them data centers. That is more than five times the grid's record peak demand.

Much of that queue is paper. Developers get in line early because the line is long, and many projects fizzle. But even a fraction coming true would break the grid. Abbott first asked nicely with a voluntary survey. Only 28 of 377 companies answered, which one state rep called "pretty pathetic". So the state stopped asking.

What the audit actually asks for

This is not a rubber stamp. The audit forces developers to disclose their tax breaks, their real grid draw versus on-site power, their water source and consumption, and their plans for noise mitigation, light controls, and traffic. It also wants to know who actually owns the project.

If your roadmap assumes a partner can spin up a Texas facility on a known date, that date is now unknown. As The Verge notes, nobody knows how long the audit takes or how much it slows things. Texas was the fallback when other places got hard. New York already passed a statewide moratorium. The easy region just got a queue and a clipboard.

The workaround that turned into a lawsuit

When the grid won't have you, you make your own power. That is what SpaceX did near Memphis, running 69 gas turbines to power its Colossus data centers without permits. The company's argument is that the turbines sit on their shipping trailers, so they don't count. Federal regulators disagree.

The turbines can emit more than 2,000 tons of smog-forming NOx a year in a region already rated unhealthy. The NAACP and Southern Environmental Law Center sued. Residents of the mostly Black neighborhood of Boxtown say the fumes make it hard to breathe. Even with the DOJ siding with SpaceX on "energy security," the full turbine removal is pushed out to July 2027. Bypassing the grid did not buy speed. It bought a court fight and a year of bad press.

The neighbors are the new gate

The part that should reset your risk model is who is showing up to fight. Futurism counted at least 37 arrests tied to data center protests this year, and these are not professional activists. They are farmers, physics teachers, suburban parents. Lux Claridge, a teacher in Emporia, Kansas, got arrested for clapping at a public meeting.

Erin Brockovich's crowdsourced tracking logged more than 1,300 residential complaints in Texas alone, double the next state. Sulphur Springs residents filed nearly 400. This is the pressure that produced the audit. Local anger is now a scheduling variable in your infrastructure plan, whether your vendor tells you that or not.
